Proposed North Carolina HOA Legislation

Two bills were introduced in the General Assembly yesterday that have huge implications to community associations:

(1)House Bill 165 is the anticipated omnibus bill from members of the House Select Committee on Homeowners Associations. The bill and its sponsors can be viewed at: http://www.ncga.state.nc.us/gascripts/BillLookUp/BillLookUp.pl?Session=2011&BillID=hb165

(2)House Bill 183 would prohibit foreclosure for delinquent assessments. The bill and its sponsors can be viewed at: http://www.ncga.state.nc.us/gascripts/BillLookUp/BillLookUp.pl?Session=2011&BillID=hb183

 

Both bills will be reviewed by many in the coming days.  It is likely that those in the community association, real estate, and legal communities will have specific responses.  

 

As you can see, these bills propose damaging changes to the powers of North Carolina HOA’s and COA’s.  Community Association Management will be working in conjunction with CAI’s Legislative Action Committee to attempt to modify or kill these proposed bills.
