Last month, final regulations related to the Fair Housing Act were released by the U.S. Department of Housing and Urban Development (HUD), and the final rule is effective October 14, 2016.

Community associations may be liable under the Act for the discriminatory actions of residents who harass or create a hostile environment for other residents. Both FHA and ADA (Americans with Disabilities Act) rules apply to every community- and every board member needs to understand them. Board members in both self-managed and externally managed communities are ultimately responsible for compliance- financial consequences could follow if you make a mistake.

Mike Hunter, Cynthia Jones, and Bill Hamel will discuss the various aspects of FHA/ADA that apply to every community and offer the opportunity for you to ask questions and seek clarification directly from attorneys that are fully knowledgeable of issues regarding FHA/ADA compliance.

We will also briefly discuss how important it is that your D&O policy has proper coverage for you and your community in the event you or your community become a party to any claim or suit involving violations of the FHA/ADA regulations. This is extremely important as not all D&O policies are the same and many do not protect you if someone claims you have discriminated against them based on their legally protected status, whether it be race, family status, disability, sex, or other federally protected status.
