SC Open Meeting Law

The issue of whether South Carolina HOAs (with respect to Board Meetings) are subject to the “open meeting law” is an often-asked question.  Following is an opinion on the issue, along with advice provided by one of our Chapter’s prominent HOA attorneys:

South Carolina does not have a statute which addresses Homeowner Associations of single family lots.  There is a statute which addresses condominiums known as the Horizontal! Property Regime Act References are made in this Act to the to the contents of the Bylaws as to the administration of condo regimes but they are broad and genera! statements without much detail The subject of “open meetings” is not addressed.

NC Legislative Update

The North Carolina General Assembly will reconvene for the 2010 Session of the 2009 General Assembly (the “Short Session”) at 12:00 noon on Wednesday, May 12, 2010. It is likely that House Bill 762 titled the North Carolina Community Association Managers Licensure Act, which was filed in the 2009 Session, will be considered.

SC Planned Community Act

In 2009, the South Carolina Legislative Action Committee (SCLAC) drafted a proposed Planned Community Act (PCA) as an alternative to Senate Bill 30.  During the Senate Judiciary Committee Subcommittee meetings last year, certain provisions within the SCLAC were considered. 

There has been NO ACTIVITY on Senate Bill 30 during the current legislative session.
